What changed under the HB 837 for Personal Injury Protection (PIP)?

One-Way Attorney’s Fees Largely Eliminated

Before HB 837:

Florida law allowed medical providers who successfully sued insurance companies to recover their attorney’s fees from the insurer. This “one-way attorney’s fee” rule helped level the playing field between individual providers and large insurance companies.

After HB 837:

The law has undergone significant changes. In the majority of PIP cases, the one-way attorney’s fee provision has been repealed. As a result, even when a medical provider prevails in litigation against an insurer, they may nonetheless be required to bear their own attorney’s fees—thereby increasing the legal and financial barriers to asserting otherwise valid claims.
